1. Acceptance of Terms

By downloading, installing, or using ForkIt! ("the app"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app.

2. Description of Service

ForkIt! is a location-based restaurant discovery app that randomly selects nearby restaurants based on your location and filter preferences. The app includes both free and paid subscription features.

3. Free and Pro Tiers

ForkIt! offers a free tier with limited monthly usage and two paid subscription tiers with expanded features:

• Free Tier: 10 searches per month, 1 Fork Around group session per month, basic filters (distance, keywords, hidden gems), and a basic result card (restaurant name + Google Maps link). Re-rolls within a cached pool of results do not count as searches. Free usage resets on the 1st of each month.
• ForkIt! Pro ($1.99/month): 20 searches per month, 3 Fork Around sessions per month, all filters (price, rating, open now), full result card (rating, price, hours, address, website, call), and alternative picks in different categories.
• ForkIt! Pro+ ($2.99/month): Unlimited searches and Fork Around sessions, plus all Pro features.
• Annual plans: Available at $14.99/year (Pro) and $24.99/year (Pro+).

4. Subscriptions and Billing

• ForkIt! Pro and ForkIt! Pro+ are offered as auto-renewable subscriptions with monthly and annual billing options.
• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Your subscription automatically renews unless canceled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• You can manage and cancel your subscription in your device's subscription settings (Apple: Settings > Apple ID > Subscriptions; Android: Google Play > Subscriptions).
• No refunds will be provided for partial subscription periods. Refund requests should be directed to Apple or Google per their respective refund policies.

5. Location Data

ForkIt! requires access to your device's location to function. By using the app, you consent to the collection and use of your location data as described in our Privacy Policy.

6. Third-Party Services

ForkIt! relies on third-party services including Google Places API for restaurant data. We do not guarantee the accuracy, completeness, or availability of third-party data. Restaurant information (hours, ratings, prices) is provided by Google and may not always be current.

7. Fork Around (Group Sessions)

Fork Around allows users to create group decision sessions. By using this feature:

• You agree that your chosen display name will be visible to other session participants.
• Session data is temporary and automatically deleted after 24 hours.
• Sessions are limited to 8 participants.
• You will not use this feature to harass, spam, or distribute inappropriate content through display names.

8. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the app.
• Attempt to bypass usage limits, subscription requirements, or security measures.
• Use the app for any unlawful purpose.
• Interfere with or disrupt the app's servers or connected networks.
• Use automated systems (bots, scrapers) to access the app or its data.

9. Intellectual Property

ForkIt! and all associated content, features, and functionality are owned by the developer and are protected by copyright and other intellectual property laws. The ForkIt! name, logo, and branding are trademarks of the developer.

10. Disclaimer of Warranties

ForkIt! is provided "as is" and "as available" without warranties of any kind. We do not warrant that:

• The app will be uninterrupted, error-free, or secure.
• Restaurant information will be accurate or up to date.
• Results will meet your dietary needs, allergies, or other requirements.
• The app will be available in all locations or on all devices.

You are responsible for verifying restaurant details (hours, menu, allergens) before visiting.

11. Limitation of Liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to dissatisfaction with a restaurant suggestion, inaccurate business information, or service interruptions.

12. Changes to Terms

We may update these Terms of Use from time to time. The "Last Updated" date will be revised accordingly. Continued use of the app after changes constitutes acceptance of the updated terms.

13. Termination

We reserve the right to suspend or terminate your access to the app at any time for violation of these terms. You may stop using the app at any time by uninstalling it and canceling any active subscriptions.

14. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms shall be resolved in the appropriate courts of the United States.
